Community Design Regulation

A Commentary

Edited by: Gordian N. Hasselblatt

Council Regulation (EC) No 6/2002 on Community designs (CDR) protects the appearance of a design against counterfeiting and piracy, be it registered or unregistered. The right is applicable throughout the European Union. The registered design is obtained in a single procedure from the Office for Harmonization in the Internal Market in Alicante. This commentary offers a detailed article-by-article analysis of the provision of the Regulation and its enforcement in each Member State of the EU. Wherever feasible, the commentary provides an account of specific bibliography, gives a historical overview, shows the main features and principles underlying the provision, and analyzes each paragraph with due regard to the case law of the European courts and the Supreme Courts of the Member States. [Subject: European Law, Public International Law, Copyright Law, Patent Law, Trademark Law]
